Guest Terms and Conditions of Stay
General Terms and Conditions
These terms and conditions apply between Bali and Eva Midlands (Pty) Ltd (“B&EM”) and the person/s and/or entities (“Guest”) visiting B&EM’s (“Property/ies”).
By accepting the rates, you agree that you have read and understood these Terms and Conditions, including all policies, and agree to be bound by them. B&EM may, in its absolute discretion and at any time, change the conditions of stay without any notification to current or prospective Guests.
- The property units accommodate 22 (twenty-two) guests and has a Hall for Guest dining and lounging. The peace and tranquillity experience for ALL Guests are of utmost importance to us and in line with the countryside touch of the area. The following rules shall apply to the use of the facilities:
• The units in the Hall are for the exclusive use of the Guests. Any Guest visitors shall be by prior approval of B&EM, shall be charged a rate for an overnight stay and leave the Property by 12 midnight of the same day, unless extended by prior arrangement and approval by B&EM. B&EM shall in its sole discretion, in making such approval/s, take into consideration the risk of safety, disruption, annoyance, or any damage to other Guests and their property.
• Group bookings by Guests of an entire Property shall adhere to the strict visitor rules. As soon as Guest numbers exceed 22, the booking shall be treated as an event which will be billed accordingly and approved at the sole discretion of B&EM taking into account the requirements of the event booker.
- We welcome and support Guests with accessibility needs and always consider reasonable accommodation requests from such Guests. We have a family unit with full accessibility provisions and our Hall is also fully accessible and compliant. Mobility impairment accessibility features include:
•Ramp access to one of bedrooms in paraplegic unit
•Ground floor paraplegic unit
•Wide entrance into bathroom from bedroom
•Fully wheelchair accessible bathroom with open plan shower with space seat, grab rails and wheelchair accessible basin
•Spaces on each side of bed
•Designated working space for each bedroom
•Spiral ramp access to Hall
- No pets are allowed on the Property.
- Guests, including sharers, will be required to produce an authentic form of identification at the time of check-in. A copy will be taken and securely stored. Acceptable forms of identification are:
• South African Identity book
• South African Identity card
• Valid passport.
To reserve a booking, prospective Guests shall provide B&EM with the following information:
• Address, name, and telephone number of the Guest;
• Date(s) of the stay, estimated time of arrival, and telephone number and name of the applicant; and
• Other information deemed necessary by B&EM.
- All information obtained in any brochure, or catalogue which accompanies or forms part of any tender or advertisement made by B&EM, which shall include prices, is subject to change and B&EM will not be bound to comply exactly therewith.
- Guests should ensure that their room door/s is/are properly secure at all times. B&EM cannot be held responsible for any personal items and valuables left in guest rooms.
- Guests will be held responsible for any missing or damaged items in their units or any internal/external areas of the Property. This liability extends to both registered Guests and their visitors.
- We strive to provide our guests with ultimate comfort and luxury but sadly items do go missing. We have installed electronic chips on our assets including linen, gowns, art, furniture, hair-dryers, etc which can be detected through a beeping sound if removed and likely cause distress to our Guests. We reserve our rights in such occurrences and where our assets are removed from the rooms.
- Smoking in the rooms/family units, lounges and Hall is strictly prohibited.
- Should you not agree to these Terms and Conditions, your use of our services is immediately terminated. We reserve the right to amend the Terms and Conditions at any time and without notice to you. You are advised to regularly check whether these terms have changed. The most recent version will be available on www.baliandeva.co.za.
Indemnity
The Guest, its employees, visitors, or invitees enter and/or access and/or use the premises of the Property at their sole and exclusive risk. Neither the owner of these premises, nor the Property, its subsidiaries and/or associated companies, their workmen, employees, sub-contractors, and/or agents are or may be held liable and/or responsible for any direct, indirect, special, punitive, incidental, exemplary, consequential or any other loss or damages. This can be caused through the negligence of the owner, or arising out of any other cause whatsoever, including but not limited to damages or loss or personal injury or fatal injury caused by fire, theft, floods, force majeure, third-party acts, civil unrest and/or insurgence, to the parked vehicles or any content left therein or for any injuries or fatality suffered by any person entering, accessing or using these premises. The person entering, accessing, or using these premises, hereby indemnify and hold harmless the owner against all and any claims of whatsoever kind of nature and howsoever arising, which may be made against the owner by any claimant whatsoever in respect of personal injury, fatality, or damage to vehicles or property, occurring or arising out of any one or more of the incidents set out above, nothing omitted.
